Voluntary Participation
I desire and request to voluntarily participate in a medical education/training course and/or any general education/training event occurring at the Viticus Center, a facility owned by WVC, dba Viticus Group (herein referred to as Viticus Group), in Las Vegas, Nevada. I confirm that my participation in this a medical education/training is on a voluntary basis, and I recognize that there is inherent risk in medical education/training including personal injury and unintentional exposure to pathogens. I understand that during this training course when x-ray equipment is in use, I may be exposed to radiation. By following the principles of time, distance, and shielding, I can minimize my exposure to radiation. I have the option to leave the room during use of x-ray equipment.
In exchange for my right to voluntarily participate in this medical education/training course and/or any general education/training event and the benefits derived from such participation as well as other good and valuable consideration, I assume all risks associated with such participation and hereby release, hold harmless, discharge, waive, and relinquish any and all claims, actions, or causes of action against Viticus Group, its current and past employees, officers, directors, agents, successors, contractors, and representatives whether past, present, or future, known or unknown, and anticipated or unanticipated by me or others as to liability, loss, claim, damage, or injury (including death) to me or my property or to any other person or property arising or in any manner relating to my participation or the participation of others in this medical education/training course. This release shall be binding on my heirs, administrators, executors, successors, and assigns.
In addition, I hereby agree to defend, indemnify, and hold Viticus Group harmless free and clear against any and all demands, liabilities, claims, actions, causes of action, judgments, debts, costs, penalties, obligations, interest, damages, and expenses of any amount or nature whatsoever incurred by or imposed upon Viticus Group, or any one or more of them, as a result of, in relation to, or in any way connected with, or arising out of my failure to use some or all of the appropriate person protective equipment. Expenses include attorney fees and all other expenses consisting of but not limited to costs and fees incurred in the investigation, defense, adjustment, or settlement of claims or potential claims asserted by any party, including myself, against Viticus Group, relating in any respect to my participation in this medical education/training course.
In courses where the use of personal protective equipment has been recommended and provided to me. I understand that failure to use equipment may increase my risk of exposure to infectious materials, diseases, and/or injury. I assume all additional risks assocated with any such unprotected participation. I certify that (1) I have received training in handling and am aware of the risks of handling blood borne pathogens: and/or (2) I am a medical professional and, based on my training as such, am aware of the hazards presented by blood borne pathogens and the controls to prevent exposure.
Unlawful Harassment and Discrimination Policy
Viticus Group is committed to providing a work environment that is free from all forms of discrimination and conduct that can be considered harassing, coercive, or disruptive, including sexual harassment. Actions, words, jokes, or comments based on an individual's sex, race, color, national origin, age, religion, disability, sexual orientation. gender identity, or any other legally protected characteristic will not be tolerated. Viticus Group provides ongoing sexual harassment training to ensure our employees have the opportunity to work in an environment free of sexual and other unlawful harassment.
Sexual harassment is defined as unwanted sexual advances or visual, verbal, or physical conduct of a sexual nature. This definition includes many forms of offensive behavior and includes gender-based harassment of a person of the same sex as the harasser. The following is a partial list of sexual harassment examples:
- Unwelcome sexual advances (either verbal or physical), requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment.
- Physical conduct that includes touching, assaulting, or impeding or blocking movements.
Our employees are trained and understand the need to report harassment in the workplace to the Viticus Group Executive Management Team.
